Attempt to rape is that offence which equivalent to attempt to suicide so for this reason attempt to rape should also be treated as harshly as attempt to suicide is treated. So that victims whether an adult or a minor should be given proper justice for the same in order to come out of trauma which is a serious one in it's nature.

i liked the comments by lekhni published on 16 january 2010. i agree that little punishment of 6 months to the sexual abuser is a shame for our legal system but the positive thing in all this scene is that the ruchica family got justice and real face of the abuser came before the public. thanks to media and efforts of NGOs.

The words show how archaic IPC is. And if you read that SC decision on attempt to rape, you'd be even more amused by this sentence:
Addressing the issue of a child being the victim of an offence of outraging of modesty, the judges, quoting another judgment relating to a case involving a seven-month-old baby, said a girl possesses from birth the modesty that is the attribute of her sex.

Very thooughtful post. I would like to add just a couple of thoughts of my own:
1. The law should be designed not just to punish but also to deter. The perpatrator of an attempted rape remains just as much of a threat to society as one who has raped successfully. If this potential rapist is not deterred, he will "attempt" rape again and perhaps this time he will succeed.
2. It is shameful that Indian society tolerates so much abuse of girls and women, both in private and in public. The fact that so many Indians refer to molestation on the streets and buses of our cities as "eve-teasing" is a sign of this tolerance of abuse. No doubt we need good laws, properly enforced, to protect our citizens. But do we not also need to stop tolerating molestation, marital rape, domestic violence, extreme "ragging" etc?

The words IPC uses to describe or even cover such crimes are actually surprising. Rape or Attempt - describing it as just "Insult to modesty" - how can all that be just covered by such broad words I ask.
The difference in punishment for one who attempts suicide n the one who attempts to rape - I think that says it all about the IPC. One shouldve been provided care after the suicide attempt but instead the system condems it and punishes harshly and the other case, the person as we see can blackmail n torture and keep his crime under cover and even when punished, can get away quite easily. Bad, really bad.
